End User License Agreement

Effective Date: May 30, 2026

This End User License Agreement ("EULA") is a binding agreement between you and CartridgeID LLC ("CartridgeID," "we," "us," or "our") governing your use of the CartridgeID mobile application and any related software (the "App").

By downloading, installing, or using the App, you agree to this EULA. If you do not agree, do not download, install, or use the App.

1. License grant

Subject to your compliance with this EULA, our Terms of Service, and our Privacy Policy, CartridgeID grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device you own or control, solely for your personal or professional use of the Service.

2. License restrictions

You may not:

  • (a) Sublicense, sell, rent, lease, or transfer the App or any rights to use it;
  • (b) Modify, adapt, translate, or create derivative works of the App;
  • (c) Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App, except to the extent expressly permitted by applicable law;
  • (d) Remove, alter, or obscure any copyright, trademark, or proprietary notices contained in the App;
  • (e) Use the App to develop a competing product or service;
  • (f) Use the App in any manner that could damage, disable, overburden, or impair our servers or networks;
  • (g) Use the App for any purpose that is unlawful or prohibited by this EULA, our Terms of Service, or applicable law.

3. Updates

We may automatically update the App from time to time. You agree to receive updates, and you acknowledge that updates may modify functionality, fix bugs, address security issues, or otherwise change the App.

4. Account requirements

Use of the App requires a CartridgeID account. Your use of the account is governed by our Terms of Service. By using the App, you also agree to those Terms of Service.

5. Cartridge identification and parts ordering

The App provides access to our cartridge identification and parts-ordering services. The scope, limits, disclaimers, and your responsibilities regarding these services are described in our Terms of Service. By using the App for identification or ordering, you agree to those Terms.

In summary (but not limited to what is described in our Terms of Service):

  • Cartridge identification is a professional opinion, not a warranty
  • Installation is your sole responsibility
  • We are not liable for property damage, water damage, personal injury, or other harm resulting from installation
  • Returns are governed by our Return Policy

6. Apple-specific provisions (App Store distribution)

If you obtained the App through the Apple App Store, the following additional terms apply:

  • (a) This EULA is between you and CartridgeID LLC, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • (b) The license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.
  • (c) Apple has no obligation to provide maintenance or support services for the App. If you have questions or need support, contact us at support@cartridgeid.com.
  • (d) Apple is not responsible for addressing any claims you have relating to the App, including but not limited to product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection claims.
  • (e) In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, CartridgeID, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • (f) Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

7. Google-specific provisions (Google Play distribution)

If you obtained the App through Google Play, the following additional terms apply:

  • (a) You acknowledge that Google Play is not a party to this EULA.
  • (b) Your use of the App must comply with the Google Play Developer Distribution Agreement and the Google Play terms of service.
  • (c) Google has no obligation to provide maintenance or support services for the App.

8. Termination

This EULA is effective until terminated. We may terminate this EULA at any time if you fail to comply with any of its provisions. Upon termination, you must stop using the App and delete all copies from your devices.

Sections governing limitation of liability, warranty disclaimers, and indemnification survive termination.

9. Warranty disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARTRIDGEID LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). Additional limitations and disclaimers are described in our Terms of Service, which are incorporated by reference into this EULA.

11. Governing Law

This EULA is governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be resolved per the Dispute Resolution section of our Terms of Service.

12. Changes to this EULA

We may update this EULA at any time. If we make material changes, we will notify you through the App and/or by email. Continued use of the App after the effective date of any updated EULA constitutes your acceptance.
